Terms of Use
These Terms govern Xtreme's public corporate website and distinguish website use from the separate agreements that govern software-development, engineering and technology services.
Acceptance and scope
These Terms of Use govern access to and use of the public corporate website operated by Xtreme Solutions Systems SMC (Pvt.) Ltd. By using the website, you agree to these Terms to the extent permitted by applicable law. They do not replace a signed master services agreement, statement of work, proposal, license, NDA, employment agreement or other written contract. A signed agreement controls the contracted services it covers.
Website purpose
The website provides general information about Xtreme, its capabilities, industries, selected work, engineering perspectives and contact channels. Website content is not a binding offer to provide services on particular scope, price, schedule, architecture, staffing or commercial terms.
Eligibility and lawful use
You may use the website only lawfully. You must not violate law or third-party rights; introduce malware; disrupt availability or security; bypass access controls; conduct unauthorized vulnerability testing; harvest personal information unlawfully; impersonate others; submit fraudulent information; or use automation in a manner that materially burdens the website or circumvents restrictions.
No client or other relationship
Viewing the website, submitting an inquiry or exchanging preliminary communications does not by itself create a client, fiduciary, partnership, joint venture, employment, agency or other professional relationship. Services begin only under mutually accepted commercial terms or another appropriate written agreement.
Proposals, estimates and communications
Any proposal, estimate, timeline, architecture or commercial information sent in response to an inquiry is subject to its own assumptions, terms and validity period. Unless expressly stated in a signed agreement, website statements are not fixed quotations, delivery guarantees or commitments to provide a particular team, technology or result.
Intellectual property
The website's original text, design, layout, graphics, branding, code and other materials are protected by applicable intellectual-property law to the extent owned or licensed by Xtreme. Visitors receive a limited, revocable, non-exclusive, non-transferable permission to view the public site for legitimate informational and business purposes. No ownership is transferred. Substantial website content may not be republished, sold, licensed, distributed or commercially exploited without permission except where law expressly permits it.
Portfolio and third-party rights
The website may reference client projects, products, technologies, trademarks, screenshots or third-party services. Third-party names and marks belong to their respective owners; reference does not necessarily imply endorsement, partnership or sponsorship. Portfolio descriptions communicate the nature of Xtreme's work and may reflect a particular project phase. Unless expressly stated and verified, they do not claim that Xtreme currently operates, owns or exclusively developed every component of a referenced third-party system.
User submissions
If you send an inquiry, requirement, résumé, document or other material, you represent that you have the right to provide it. Do not send passwords, private keys, regulated records, source-code secrets or other highly sensitive/confidential material through a general inquiry channel. You retain ownership of your material and authorize Xtreme to use and internally share it only as reasonably necessary to evaluate/respond, administer the potential relationship and comply with law. This clause does not transfer ownership of your project idea or proprietary material.
Third-party links and services
The website may link to third-party sites, social networks or services for convenience. Xtreme does not control them and is not responsible for their content, availability, security, terms or privacy practices. A link alone is not an endorsement.
Availability and changes
We may modify, update, suspend, restrict or discontinue all or part of the public website. We do not promise continuous, uninterrupted or error-free website availability or compatibility with every device/browser. Contractual service levels apply only when expressly agreed in a separate written contract.
Security and responsible conduct
Unauthorized access to systems, accounts, data or restricted areas is prohibited. Security testing must not be performed against Xtreme systems without prior written authorization defining scope. Suspected security issues should be reported through the published contact channel without accessing, retaining, changing or disclosing data beyond what is reasonably necessary to describe the issue.
Informational and AI content
Articles, engineering notes, industry guides and AI-related materials are general engineering perspectives, not legal, financial, medical, regulatory or other professional advice. AI examples describe possible patterns; model behavior, accuracy, cost, availability and suitability depend on data, providers, configuration, evaluation and use case. Website content is not a warranty of AI output or business outcome.
Disclaimer of warranties
To the maximum extent permitted by law, the public website and content are provided on an “as is” and “as available” basis. Xtreme does not make a website-level warranty that content is complete, continuously current, error-free, uninterrupted or fit for a visitor's particular purpose. This does not exclude obligations that cannot lawfully be excluded or alter express warranties in a separate signed services contract.
Limitation of liability
To the maximum extent permitted by applicable law, Xtreme will not be liable solely because of use of or inability to use the public website for indirect, incidental, special, consequential, exemplary or punitive loss, or loss of profit, revenue, data or business opportunity, where exclusion is legally permitted. These Terms do not override liability provisions in signed client agreements or exclude liability that law does not permit to be excluded.
Indemnity
To the extent permitted by applicable law, you are responsible for claims, losses or expenses arising from unlawful misuse of the website, material breach of these Terms or material you submit in violation of another party's rights.
Privacy
Our Privacy Policy explains how personal information associated with the website and related business communications is handled. Please review it together with these Terms.
Rights complaints
If you believe website material infringes copyright, trademark or another right, contact Xtreme with enough information to identify the material, the right asserted and a way to respond. We may remove or restrict material while a credible claim is reviewed.
Changes to Terms
We may update these Terms when the website, business practices or legal requirements change. Revised Terms will be posted with an updated effective date. Continued use after an update constitutes acceptance only to the extent that mechanism is valid under applicable law.
Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to conflict-of-laws principles to the extent such principles would require the application of another jurisdiction's laws. Any dispute arising out of or relating to the use of this website will be subject to the jurisdiction of the competent courts of Pakistan, except where applicable law requires otherwise.
Severability, waiver and assignment
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law and the affected provision should be modified only as necessary. Failure to enforce a provision once does not necessarily waive future enforcement. Xtreme may transfer website-related rights and obligations as part of a lawful reorganization, merger, acquisition or transfer of the relevant business.
Entire website terms
These Terms, the Privacy Policy and notices expressly incorporated into them form the general terms governing the public website. They do not supersede signed agreements governing services, employment, confidentiality, licensing or other business relationships.
